US & HK violence : (Part 3) Stability through the rule OF law
This blog is the third part of an indepth response to CCP's and Hong Kong (HK) government's narrative concerning the comparison made of Hong Kong's 1 July 2019 Legislative Council (LegCo) protest and the America capitol Washington D.C. 6 January 2021 insurrection. In his book "The Rule of Law" Lord Bingham suggests (page 8) "the core of the existing principle [of the rule of law] is, I suggest, that all persons and authorities within the state, whether public or private, should be bound by and entitled to the benefit of laws publicly made, taking effect (generally) in the future and publicly administered in the courts."
USA stability through the rule OF law
On 6 January 2021 'insurrectionists' incited by US President Trump acted AGAINST USA's rule OF law by attempting to override US Congress's legitimate Constitutional act of counting electoral votes for the next President. The insurrection failed.
The American people have spoken in their 2020 democratic elections: Trump has been fired and is facing his second impeachment.
In USA the majority believe President-elect Biden will bring about unity and stability through the rule of law.
WTPOHK suggest that leading democracies should become 'Trump-proof' all party power-sharing.
Democracy ensures stability, prosperity and the rule OF law WINS!
Communist HK's instability through CCP's rule BY law
HK protesters are protesting, demanding that the Joint Declaration be upheld to bring about unity and stability through the rule OF law.
Under Chinese Communist Party (CCP) arbitrary 'rule BY law' CCP and their minions HK government headed by Chief Executive (CE) Carrie Lam acted AGAINST HK's rule of law in February 2019 by proposing an extradition bill under which anyone in HK could be extradited to China to stand trial.
Massive peaceful public protests erupted on 9 June 2019 illustrating the will of HK people - the strong opinions of the people which Lam refused to acknowledge or support. On 1 July 2019 a few hundred HK protesters seized (where were the police?) an empty Legislative Council (LegCo) in an act to halt the final hearing of the proposed extradition bill.
Under the Joint Declaration signed between China and UK, HK must be governed with a high degree of autonomy, unchanged lifestyle, British common law and an independent judiciary until 30 June 2047.
For the ordinary mainland Chinese citizens fed CCP propaganda, the demonstrators in HK may have look like a mob going against the "rule of law", but in fact the developing protest movement was actively opposing, and even today opposes CCP's authoritarian RULE BY LAW. The ethnocentric view of mainland Chinese, no doubt has similar parallels in the west among ill-informed people who do not completely understand or appreciate what motivates Hong Kongers to protest.
Since 1 July 2020 CCP's illegal national security law breaches the Joint Declaration and now 'communist HK' is ruled directly from China. Democracy and the rule OF law LOST: CCP's totalitarian rule BY law WON creating 'communist HK'!
For prosperity a country or city first needs 'stability'. In WTPOHK's opinion long lasting stability and hence prosperity can best be realized by an all party power-sharing democracy under the rule OF law.
A population with fundamental human rights under the rule OF law is able to freely achieve what it needs under UN treaties and Universal Declaration of Human Rights (UDHR).
CCP's method for 'stability' is to reject outright the rule OF law including UN Universal values; CCP does whatever it wants to do without consideration of any agreement or anything else that stands in the way; CCP controls everything in China including the judiciary, businesses, etc.; CCP's only goal is to remain in power no matter what happens; CCP is corrupt; CCP uses violence to ensure 'stability'.
WHAT? CCP rules China, and despite not qualifying, is a member of UN, WTO, WHO and other international rule OF law bodies. China was introduced to these internatonal bodies 'under the wing' of USA! This is de-stabalizing the democratic world and hence negatively impacting our prosperity!
Under China's Constitution CCP is the 'peoples democratic dictatorship'. CCP is the world's worst ever totalitarian state that has killed upwards of 77 million Chinese people. CCP's Emperor Xi Jinping believes nationalist China's place is the Middle Kingdom around whom the world revolves. China is ranked worldwide 79th for its GDP/ capita and is a poor country despite its bleatings of 'economic progress'.
CCP has been unmasked in public by HK protesters! Since 1 July 1997 each Chief Executive in HK has been worse than the previous and no CE has finished a second term: i.e. HK has a systemic political crisis which can not be resolved because of CCP's constant illegal interventions as a 'foreign power' into HK.
After HK protests began in 2019 CCP attempted everything it could (i.e. violence and police invasion of Chinese University and Polytechnic University) within its 'one country two systems' HK policy. Then on 24 November 2019 District Council elections were held in which pro-CCP candidates lost by a landslide to pro-democratic camp! Following this defeat CCP and Emperor Xi lost 'face': Fearing a major defeat to CCP control 6 September 2020 Legislative Council elections were 'postponed' and CCP illegally annexed HK by enacting a rule BY law China version of national security laws for HK.
In breach of the Joint Declaration HK's governance is now directed by CCP: 'communist HK' rule BY law will not change until CCP is removed from China!
CCP’s takedown of HK is part of its strategy of world domination. What CCP has learned from this struggle in HK it will apply worldwide if it can get away with it!
WTPOHK have a suggested method to resolve the current HK political crisis: it involves inviting all HK Permanent Residents 18 years old and above to participate in a referendum held in HK using the “Modified Borda Count” (MBC), a preferential multi-option voting system, offering 5 options which will be ranked by each voter according to their preferences. If necessary, this could be a UN mandated referendum. The results acted upon would negate the breaches of China allowing the amended Joint Declaration agreement to continue.
'Communist HK' rule BY law will not change until CCP leaves China! Decouple from CCP!
