Communist HK's illegitimate 2021 Legislative Council 'elections'
Updated: Dec 18, 2021
If you are not based in Hong Kong (HK) you may not know that the place is having an election of sorts in the not too distant future.
WTPOHK, by upholding the UN international treaty the Joint Declaration and the rule of law, remains focused on Hong Kong (HK) peoples' decades long ongoing demands and protests for reforms to HK's political system and governance. Our solution is a referendum, which acted upon, would allow the Joint Declaration to continue (Please read last paragraph below).
HK pro-democracy protesters have, among other things, been trying to get their government to uphold UN treaties and obligations including ICCPR, Joint Declaration and HK's rule OF law. The coming election does not offer any hope that these matters will be resolved.
The nationalist Chinese Communist Party (CCP), and their minions the HK government, are in BREACH of UN obligations including ICCPR, Joint Declaration and HK's rule OF law. Today, communist HK only has CCP's arbitrary rule BY law, as exampled by CCP's 1 July 2020 'national security law' which it used to annex HK.
We use the term 'illegitimate' to describe the 2021 Legislative Council (LegCo) 'election' because CCP's own 'Basic Law' article 68 says 'The Legislative Council of the Hong Kong Special Administrative Region shall be constituted by election'. Under UN treaty obligations of the ICCPR 'HK Bill of Rights Ordinance' (HKBORO) Cap.383 Article 21 and Universal Declaration of Human Rights Article 20.3 all elections are required to be 'universal and equal suffrage'. CCP pre-British handover on 1 July 1997, in breach of the Joint Declaration, CCP created a 'Provisional Legislative Council' (PLC). CCP once again unlawfully in 2020 used a PLC via its NPC when the previous 2016 LegCo term ended after four years.
The 2021 LegCo 'election' is best described as a CCP 'selection' process ensuring that CCP maintains control over HK using the 'monolithic power structure' of the communist HK government. This also includes authority over the non-independent judiciary under its rule BY law.
HK people around the world will continue to confront the unlawful CCP and HK government until they are given what is lawfully their UN human rights.
Of the 2019 HK protester's 'five demands' only one demand was met by HK government - the withdrawal of the proposed extradition legislation in September 2019. Of the remaining four demands, one of the most important is the UN ICCPR human right to 'universal and equal suffrage elections': The other key demand is an independent investigation of the police role in the 2019 protests. Still today the majority of HK protesters remain supporting their 'five demands'.
HK is a feudal Han Chinese plutocracy run by the Chinese elite minority for their and CCP's sole benefit: HK, despite being one of the world's wealthiest cities, has at least a 20% poverty rate. Universal and equal suffrage elections would finally allow the majority of HKers (approximately 70%) to take control of the Legislative Council (LegCo) and create a fully functioning democracy.
In 2007 CCP, facing increased public protests since 1997, agreed for universal and equal suffrage elections for all HK elections starting in 2016. However, in August 2014 CCP reneged on this agreement, after which HKers replied roughly two weeks later with the 2014 Occupy Central and Umbrella movement, This then in turn, lead on to the 2019 anti-extradition protests which today remains an ongoing civil resistance movement.
The 24 November 2019 District Councils elections, HK's only universal and equal suffrage elections, was won in a landslide victory by pro-democratic candidates with a majority in 17/18 districts. CCP had tried everything in the runup to the elections to shutdown protests including illegal sieges of Chinese University and HK Polytechnic University. This was the first ever loss for CCP in HK elections, and it signaled that CCP could lose control of LegCo and therefore HK. The paranoid CCP lost 'face' and fearing the upcoming 6 September 2020 LegCo elections it chose, under the disguise of 'COVID-19' global pandemic, to push the 'nuclear option' and nuked everyone and everything with its 1 July 2020 'national security law' (NSL) which installed its arbitrary rule BY law.
The two key problems are that China is a Han Chinese feudal plutocracy and CCP's Emperor Xi Jinping has 'no clothes' (i.e. he is clueless)!
Here is a brief list of the current outstanding issues facing HK's governance, including its illegitimate 2021 Legislative Council (LegCo) 'election':
HK people have their UN fundamental rights to Self-determination which is being violated;
The feelings, thoughts, and opinions of HK people are being denied and suppressed by the Chinese Communist Party (CCP) and the HK government;
'Authorities' are exercising power they don't legally have, and their powers aren't being kept in check;
Legitimate non-CCP stakeholders in HK affairs are being sidelined;
CCP's NPC 'interventions' have no legal justification;
The make-up of HK's Legislative Council is deliberately unbalanced;
Flawed laws passed by a deliberately unbalanced Legislative Council (LegCo) become laws used by the Judiciary;
Those in LegCo aren't highly skilled and don't know what they're doing, and we don't know what they are doing either!;
There is a mismatch between the policies and vision of HK people, 'their' LegCo and CCP;
Time is out of kilter : LegCo is out of step;
CCP and their minions are exploiting HK's Public Purse.
CCP arbitrary creates 'red lines' to entrap HK people within its monolithic power structure which includes the non-independent judiciary.
The upcoming HK 2021 LegCo elections are just another example of CCP's ever growing 'virus of governance' that to date has resulted in the deaths of at least 77million people in China since 1949!
CCP has since 1949 refused to allow democracy in HK. This has always been, and will always be, CCP's problem which it alone must fix if it wishes to have 'normalized' relations with its citizens, other peoples and nations under the rule of law.
Currently, all HK pro-democratic politicians, lawmakers and leading activists are either in prison, on remand awaiting a criminal 'trial' or in exile!
While China can insist that it has democracy (of sorts) and make claims about the failures of democracy elsewhere, the world looking on finds its authoritarian dictatorship is abhorrent, and its ongoing denial of universal human values and attempts to erase them are detestable.
There are many lies throughout the history of CCP which are used as part of its structural violence of torture by coercion of the people of China for 'stability and prosperity' to ensure that CCP remains in power : i.e. if you want 'prosperity' then you must accept and support CCP's actions for 'stability' which includes arbitrary disappearances, murder, Tiananmen massacre, COVID-19 source and spreading, Xinjiang genocide, HK and Tibetan annexation, etc.
HK peoples have their UN right to truth - to know what really took place, and to know about state-sponsored terrorism, including violations of human rights, forced disappearances, and torture which includes coercion.
The rest of the world, especially the democratic world, must continue to remind and demand that CCP upholds its UN obligations to the people of HK. (Please see list below).
Under HK's UN international treaty obligations including the UN Charter, Universal Declaration of Human Rights, ICCPR and the Joint Declaration, HK people have their right to universal and equal suffrage elections. This singular human right lies at the core issue for the people of HK - as it does for the people of mainland China!
For the majority people of HK, the legitimate owners of a massive Public Purse, the 19 December 2021 LegCo elections are fraudulent and amount to an unlawful heist of public funds. Once these funds have been syphoned off by the corrupt CCP there will be little or nothing left for HK - then HK will be reduced to being just another dirty Chinese city. This is exactly what virus CCP does best - strip assets from people for their personal account!
WTPOHK suggests that HK people must boycott ALL HK 'elections' until, under UN treaty obligations, there is universal and equal suffrage elections for the Chief Executive, Legislative Council and District Councils.
[Update] Reddit 41 Privileged voters’ power is 7,200 times a single-vote holder’s under new LegCo electoral system
WTPOHK's solution to resolve the current HK political crisis is by inviting all HK Permanent Residents 18 years old and above to participate in a referendum held in HK using the “Modified Borda Count” (MBC), a preferential multi-option voting system, offering 5 options which will be ranked by each voter according to their preferences. If necessary, this could be a UN mandated referendum.
